Rahul Gandhi, leader of the opposition, along with Mallikarjun Kharge, who is the president of the Congress Party, among others, filed a petition in the Supreme Court of India on Monday, October 12, 2026. The petition claims that there are massive cases of deletion of voters and flaws in the SIR carried out by the Election Commission of India.
This happened as there were agitations in Delhi against the resignation of CEC Gyanesh Kumar.
Gandhi addressed this at a press conference, saying that "The Congress is fully resolved to wage the battle to safeguard the Constitution" and calling out to people by saying, "Fellow countrymen, let us walk arm in arm."
Gandhi said, “I have no value to the fight being waged. I see it as a peaceful struggle for constitutional values.”
MP Randeep Surjewala from the Congress said, “This is a fight for truth, justice, and constitution.”
The security in the capital was also a target of criticism by Gandhi. "The issue here is why is Delhi imprisoned? People not allowed to go to Delhi, the capital made into a fortress?" he remarked in Outlook.
"The thing is I went and asked them what place I could protest, and they told me 'protest at home.'" So that way they are saying we are protecting Kumar," Gandhi said.
There was no reaction of Delhi Police on that allegation in any of the reports.
The commitment to make sure that the perpetrators are brought to book is not new for Gandhi this week. On October 8 at Raj Ghat, he had accused the democracy and the Constitution of India of being "damaged and destroyed" in the past 10 to 15 years.
He clarified that the protest was not a temporary issue. “This protest is about justice for the citizens of India,” he said.
Kharge and Priyanka Gandhi Vadra were also present at the spot. They are political allegations, and no court or independent inquiry has proved them.
Incidents on Monday are just one of the series that have occurred. The Cockroach Janta Party organized a protest on October 2 in Mumbai, where more than 700 protesters were arrested. Then, on October 6, Gandhi joined the INDIA bloc to march to the Election Commission. Finally, on October 8, there was another protest in Bengaluru.
As reported by Outlook, CJP founder Abhijeet Dipke warned Kumar to step down and avoid “Jantar Mantar 2.0.”
The Election Commission has always claimed that their decisions were made unanimously by all three commissioners. Attempts in Parliament to impeach him previously have failed. As late as April 2026, the Chairman of the Rajya Sabha and the Speaker of the Lok Sabha refused to accept the impeachment notice against him.
None of the reports reviewed has included any new statement issued by the Commission to Monday’s petition.
It is notable that the documents under analysis did not provide the specifics about the petition filed to the Supreme Court, detention procedures or numbers, and the date of the hearing.
The next question is whether or not the Supreme Court puts the case up for hearing and what demands it makes on the Election Commission. The street movement will most likely continue.
